By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the App.
2. Eligibility and Age Requirements
2.1. You must be at least 13 years old to use this App. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you confirm that you have obtained parental or guardian consent.
2.2. By creating an account, you represent and warrant that:
- All registration information you submit is truthful, accurate, current, and complete
- You will maintain the accuracy of such information
- You are legally capable of entering into binding contracts
- You are not prohibited from using the Service under any applicable laws
3. Account Registration and Security
3.1. Account Creation: To use the App, you must create an account using either:
- Email and password authentication, or
- Google Sign-In (OAuth)
3.2. Security Obligations: You are solely responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
3.3. Account Integrity: You agree not to:
- Share your account credentials with third parties
- Create multiple accounts for the same person
- Create accounts using false or misleading information
- Use another person's account without permission
4. Service Description
4.1. Heats is a digital business card platform that enables users to:
- Create and customize digital business cards
- Generate unique QR codes for card sharing
- Share contact information and social media profiles
- Scan and save other users' digital cards
- Manage and organize digital card collections
4.2. Service Availability: We strive to provide continuous service but do not guarantee:
- Uninterrupted or error-free operation
- That defects will be corrected
- Freedom from viruses or harmful components
- Availability in all geographic locations
4.3. Service Modifications: We reserve the right to:
- Modify, suspend, or discontinue any aspect of the Service
- Change features, functionality, or pricing (with notice)
- Impose limits on certain features or restrict access
5. User Content and Conduct
5.1. Content Ownership: You retain all rights to content you create and upload ("User Content"), including:
- Profile information (name, title, company, bio)
- Contact details and social media links
- Profile photos and images
- Custom card designs
5.2. License Grant: By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to:
- Store, display, and distribute your content within the App
- Create derivative works for technical purposes (e.g., resizing images)
- Use your content to provide and improve the Service
This license terminates when you delete your content or account, except for cached or backup copies.
5.3. Content Responsibility: You are solely responsible for your User Content and warrant that it:
- Does not infringe any intellectual property, privacy, or other rights
- Does not contain malicious code, viruses, or harmful elements
- Complies with all applicable laws and regulations
- Does not violate these Terms
5.4. Public Nature of Cards: Digital business cards shared via QR code or link are publicly accessible. Once shared, you acknowledge that:
- Recipients can view and save your card information
- Shared information is considered "publicly disclosed"
- You control what information to include in your cards
6. Prohibited Conduct
You agree NOT to:
6.1. Illegal Activities:
- Use the Service for any unlawful purpose
- Violate any local, national, or international law
- Infringe intellectual property rights of others
6.2. Harmful Content:
- Upload content that is defamatory, obscene, threatening, harassing, or hateful
- Promote violence, discrimination, or illegal activities
- Include malware, viruses, or malicious code
- Impersonate any person or entity
6.3. System Abuse:
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service or servers
- Use automated systems (bots, scrapers) without permission
- Reverse engineer, decompile, or disassemble the App
- Circumvent security features or access restrictions
6.4. Commercial Misuse:
- Resell or redistribute the Service without authorization
- Use the Service for spam or unsolicited marketing
- Scrape or harvest user data without consent
7. Intellectual Property Rights
7.1. Our Property: All rights, title, and interest in the App, including:
- Software code, algorithms, and architecture
- Trademarks, logos, and branding ("Heats", ALUMA Ltd marks)
- Design, user interface, and visual elements
- Documentation and content created by us
are owned by ALUMA Ltd and protected by UK and international copyright, trademark, and other intellectual property laws.
7.2. Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or business purposes in accordance with these Terms.
7.3. Restrictions: You may not:
- Copy, modify, or create derivative works from our software
- Distribute, sell, lease, or sublicense the App
- Remove or alter copyright notices or branding
8. Third-Party Services and Integrations
8.1. The App integrates with third-party services including:
- Supabase (database and authentication)
- Google (sign-in and cloud services)
- Expo (mobile app framework)
- Social media platforms (via profile links)
8.2. Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for:
- Third-party service availability or performance
- Changes to third-party APIs or features
- Data practices of third parties
8.3. Third-party links included in user profiles are provided for convenience. We do not endorse or control external websites or services.
9. Subscription and Payments
9.1. Free Tier: Basic features are provided free of charge.
9.2. Premium Features: If we offer paid subscriptions:
- Pricing will be clearly disclosed before purchase
- Payments are processed through App Store/Google Play
- Subscriptions auto-renew unless canceled
- Refunds are subject to platform policies (Apple, Google)
9.3. Price Changes: We reserve the right to modify pricing with 30 days' notice to existing subscribers.
10. Privacy and Data Protection
10.1. Our collection and use of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.
10.2. By using the App, you consent to data processing as described in the Privacy Policy.

11. Account Termination
11.1. By You: You may delete your account at any time through the App settings. Upon deletion:
- Your account and User Content will be permanently removed within 30 days

11.2. By Us: We may suspend or terminate your account if you:
- Breach these Terms
- Engage in prohibited conduct
- Fail to respond to verification requests
- Remain inactive for an extended period (with notice)
11.3. Effect of Termination:
- You lose access to your account and data
- All licenses granted to you terminate immediately
- Provisions that by nature should survive will continue (e.g., limitations of liability, dispute resolution)
12. Disclaimers and Limitations of Liability
12.1. "AS IS" Basis: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability or fitness for a particular purpose
- Accuracy, reliability, or completeness of content
- Security or freedom from errors
12.2. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALUMA LTD SHALL NOT BE LIABLE FOR:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Service interruptions or data loss
- Actions or content of other users
- Third-party services or integrations
12.3. Maximum Liability: Our total liability to you for all claims arising from your use of the Service shall not exceed £100 GBP or the amount you paid us in the 12 months preceding the claim, whichever is greater.
12.4. Exceptions: Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded under applicable law
13. Indemnification
You agree to indemnify, defend, and hold harmless ALUMA Ltd, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your User Content
- Your misuse of the Service
- Your violation of any third-party rights
- Your violation of applicable laws
14. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including:
- Natural disasters, pandemics, or epidemics
- War, terrorism, or civil unrest
- Government actions or regulations
- Internet or telecommunications failures
- Third-party service outages
15. Dispute Resolution and Governing Law
15.1. Governing Law: These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
15.2. Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts of England and Wales for any disputes arising from these Terms or your use of the Service.
15.3. Informal Resolution: Before filing any claim, you agree to attempt to resolve disputes informally by contacting us at alumatechnology@alumatechnology.com. We will attempt to resolve disputes within 30 days.
15.4. Exceptions: Either party may seek injunctive relief or other equitable remedies in any court of competent jurisdiction to prevent infringement of intellectual property rights.
16. Changes to Terms
16.1. We may modify these Terms at any time. Changes will be effective:
- Immediately upon posting for non-material changes
- 30 days after notice for material changes
16.2. Notice will be provided via:
- In-app notification
- Email to your registered address
- Prominent notice on our website
16.3. Continued use of the Service after changes become effective constitutes acceptance. If you do not agree, you must stop using the Service and delete your account.
17. General Provisions
17.1. Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ALUMA Ltd regarding the Service.
17.2. Severability: If any provision is found unenforceable, the remaining provisions will remain in full effect, and the unenforceable provision will be modified to be enforceable while preserving the original intent.
17.3. Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
17.4. Assignment: You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
17.5. No Agency: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
17.6. Notices: All notices to you will be sent to your registered email address. Notices to us should be sent to alumatechnology@alumatechnology.com.
17.7. Language: These Terms are drafted in English. Any translations are for convenience only. In case of conflict, the English version prevails.
